An EMA is appointed by a special resolution passed by at least 75% of the members of the body corporate (both in value and number). If this cannot be achieved, members holding at least 25% of the total quotas may apply to the Community Schemes Ombud Service (CSOS) for the appointment of an EMA
While the EMA takes over the responsibilities of trustees, the scheme must still have at least the minimum number of trustees (two). However, a full trustee committee may not be necessary
The remuneration of an EMA is determined by the owners in the scheme, and must be agreed upon in the management agreement. It is not fixed by law.
