Whitfields is often faced with the unenviable task of asking a sectional title occupant to remove an “improvement” which they have done on the outside of their section. This may be gutters, an awning, a security gate, brass numbering to indicate your unit number, and so the list goes on.
The bottom line is that in a sectional title scheme, you only own what is inside your section. The outside walls, the roof, even the roof space between your ceiling (should there be one) and the roof tiles, are all common property. This means that such areas are collectively owned by everyone in the scheme. As such, you have no right to modify or enhance them in way, unless of course you follow the correct procedure.
This procedure would involve putting in writing your proposed enhancement, with pictures if necessary, so that the trustees can clearly know what it is you intend to do. The trustees will collectively apply their minds to your request and will make a decision, taking into account existing approved specifications, or previously approved similar changes.
Eg You wish to install pink aluminium gutters, but the scheme previously approved the installation of brown PVC gutters for anyone wishing to add gutters to the outside of their section. The trustees would decline your request, but they would advise you of the accepted specification for gutters. They would also want to know your intended position of the downpipe and may ask you to make suitable changes to the area where the water will be discharged.
Engaging with your trustees BEFORE you make any changes to common property will prevent much wailing and gnashing of teeth at a later point.
